TOWN OF RYE, COUNTY OF WESTCHESTER
A Local Law to “Establish and Authorize the Number of Deputy Receiver of Taxes and Assessments Appointed by the Town” Pursuant to NYS TownLaw Article 3 §20 (3-c).
1. Deputy Receiver of Taxes and Assessments
A. The Town of Rye has heretofore established the office of Deputy Receiver of Taxes and Assessments
B. The Receiver of Taxes and Assessments may appoint a Deputy Receiver of Taxes and Assessments. It shall be the duty of the Deputy Receiver of Taxes and Assessments to assist the Receiver of Taxes and Assessments in the performance of his orher duties.
2. Appointment of Additional Deputy Receiver of Taxes and Assessments
The Town Board of the Town of Rye hereby establishes an additional office of Deputy Receiver of Taxes and Assessments. Such deputy shall be appointed by the Receiver ofTaxes and Assessments and shall assist the Receiver of Taxes and Assessments in the performance of his or her duties. The Town Board may prescribe the duties of the additional Deputy Receiver of Taxes and Assessments.
3. Authorization
The Deputies of principal executive officers are authorized by law to act generally for and in place of their principals. The Deputy Receiver of Taxes and Assessments will act generally for and in place of the Receiver of Taxes and Assessments on all matters.
4. Residency Requirements
The person holding the position Deputy Receiver of Taxes and Assessments for the Town of Rye need not be a resident nor an elector of the Town of Rye, provided, however, that such person shall reside in the County of Westchester or an adjoining County within the State of New York.
5. Inconsistency
A. All other local laws and ordinances of the Town of Rye that are inconsistent with the provisions of this local law are hereby repealed; provided, however, that such repeal shall only be to the extent of such inconsistency and with all other respects that this local law shall be in addition to such other local laws or ordinances regulating and governing the subject matter covered by this local law.
B. To the extent that this Local Law conflicts with any of the following New York State statutes, said statutes are hereby modified and superseded by this Local Law: Town Law Section 23, Public Officers Law Section 3 and Public Officers Law Section 30.
6. EffectiveDate
This Local Law shall take effect immediately upon filing with the Secretary of State.
