LOCAL LAW NO. 1,YEAR 2024 TO AMEND LOCAL LAW NO. 2, YEAR 2023

Section 55.Town Clerk

Section 55 - 1.Title; Authority; Supersession.

This local law shall be known and may be cited as "Local Law No. 1, Year 2024 amending the local laws of the Town of Rye, by adding Chapter 55 entitled 'Town Clerk," which authorizes the Town Clerk to appoint not more than three Deputy Town Clerks. This local law is hereby adopted pursuant to the provisions of Section 10 of the NYS Municipal Home Rule Law and Section 10 of the NYS Statute of Local Governments. It is the intent of the Town Council pursuant to Section 10 of the NYS Municipal Home Rule Law to supersede the provisions of Section 30(10) of the New York State Town Law relating to the number of Deputy Town Clerk appointments the Town Clerk is permitted to make.

Section 55 - 2. Deputy Town Clerks.

A. The local laws of the Town of Rye are hereby amended to establish the number of Deputy Town Clerks that may be appointed by theTown Clerk.

B. Appointment of DeputyTown Clerks. The Town Clerk of the Town of Rye may appoint up to three (3) Deputy Town Clerks to serve at the same time. The position of Deputy Town Clerk shall be funded pursuant to the adoption of the Town Budget, subject to the amendment via resolution, by the Town Council. The Town Clerk shall have no authority regarding the salary determination for the appointed Deputy Clerks.

C. The Deputies of principal executive officers are authorized by law to act generally for and in place of their principals. The Deputy Town Clerks will act generallyfor and in place of the Town Clerk on all matters.

D. This Local Law shall take effect immediately upon filing with the Secretary of State.
